These Terms & Conditions ("Terms") govern your use of the Darby IRL website and the purchase of any digital products or memberships offered under the Darby IRL brand.

Darby IRL is a registered trade name (DBA) of Darby's Digital Agency LLC ("Company," "we," "us," or "our"). By accessing this website or purchasing any product or membership, you agree to be bound by these Terms.

1. Digital Products & Memberships

All products and memberships sold through Darby IRL are digital in nature, including but not limited to toolkits, templates, workbooks, guides, downloadable or online-access materials, and paid community memberships (including The $10K Club).

Upon successful payment:

  • You will receive immediate access to your purchased product or membership.

  • No physical goods will be shipped.

  • It is your responsibility to ensure you have the technical ability to access and use digital files and platforms.

2. The $10K Club Membership

The $10K Club is a paid recurring membership community hosted on Skool. By purchasing a membership, you agree to the following:

Monthly Plan

  • Billed at $27.00 USD per month.

  • You may cancel at any time. Cancellation takes effect at the end of the current billing period. You will not be charged again after cancellation. No refunds are issued for the remainder of the current billing period.

Annual Plan

  • Billed at $228.00 USD per year ($19.00/month).

  • You may cancel at any time. Access continues until the end of the current billing period. No refunds are issued for the unused portion of the current year.

All membership sales are final. No refunds will be issued on any membership charges.

Community Access

  • Upon purchase, you will receive an email invitation to join The $10K Club on Skool.

  • Access to the community, resources, and monthly sprint calls is contingent on maintaining an active, paid membership.

  • Upon cancellation or failed payment, access to the community will be revoked.

Community Conduct

  • Members are expected to engage respectfully and professionally.

  • We reserve the right to remove any member for conduct that violates community guidelines without refund.

3. Digital Product Satisfaction Guarantee

For standalone digital products (such as The Full Launch Kit), if the product is not what you expected or does not feel aligned for you, you may request a refund within 14 days of purchase.

To request a refund:

  • Submit your request through our website contact form within 14 days of purchase.

  • Include your order details so we can locate your purchase.

Refunds are offered in good faith. We reserve the right to deny refund requests in cases of clear abuse, such as repeated refund requests or evidence of content misuse or redistribution.

Approved refunds will be issued to the original payment method.

This guarantee applies to one-time digital product purchases only. It does not apply to membership subscriptions.

4. No Guarantees or Earnings Claims

Darby IRL does not guarantee specific results, income, business growth, or success.

All products and community content are educational in nature. Outcomes depend on many factors including your experience, effort, implementation, and external conditions. You acknowledge that:

  • Results are not guaranteed

  • Testimonials and examples are not promises of future performance

  • Revenue goals set during sprint challenges are personal targets, not guaranteed outcomes

5. Intellectual Property & License

All digital products, content, designs, frameworks, community resources, and materials — including those inside The $10K Club — are the exclusive intellectual property of Darby IRL.

When you purchase a product or membership, you are granted:

  • A non-exclusive, non-transferable, revocable license for personal or internal business use only

You may not:

  • Share, resell, sublicense, reproduce, or distribute any product or community content

  • Use the materials to create competing products

  • Post or distribute materials publicly or privately without written permission

Unauthorized use may result in legal action.

6. Payment & Pricing

All prices are listed in USD unless otherwise stated. Payments are processed securely through SamCart.

We reserve the right to:

  • Change pricing at any time

  • Offer limited-time promotions or discounts

  • Modify or discontinue products or memberships without notice

Existing members will not have their current billing rate changed without prior notice. Past purchases are not eligible for retroactive discounts.

7. Third-Party Platforms

Products and memberships may be delivered or accessed through third-party platforms including SamCart, Skool, and Zoom. We are not responsible for outages, delays, or technical issues caused by third-party services. Monthly sprint calls are hosted on Zoom — in the event of a technical outage, calls will be rescheduled or recorded and made available to members.

8. Limitation of Liability

To the fullest extent permitted by law, Darby IRL shall not be liable for any indirect, incidental, consequential, or special damages arising from:

  • Use or inability to use digital products or community membership

  • Business decisions made based on content provided

  • Technical errors, interruptions, or loss of data

  • Actions or conduct of other community members

Your sole remedy for dissatisfaction with a digital product is limited to the refund policy outlined in Section 3. Membership purchases have no remedy beyond cancellation.

9. Changes to Terms

We may update these Terms at any time. The most current version will always be posted on this website. Continued use of the site, products, or membership constitutes acceptance of any updates.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
